The court has set November 9 as the verdict in the case of embezzlement of Tk 4 crore loan from Farmers Bank against 11 accused including former Chief Justice Surendra Kumar Sinha.
Judge Sheikh Nazmul Alam of Dhaka Special Judge’s Court-4 set the date on Thursday (October 21).
ACC lawyer for the state Mir Ahmed Ali Salam later told the media that the verdict was not ready. That’s why the judge gave a new date.
Until then, the bail of six defendants has been upheld, said their lawyer. Shahinur Islam Oni informed.
Earlier, the verdict was announced on October 5. But as the judge was on leave, the date was postponed and the next verdict was fixed for October 21 (Thursday).
On August 29, the seven accused pleaded not guilty in defense and sought justice from the court.
They are- Former Chairman of the Audit Committee of Farmers Bank Limited. Mahbubul Haque Chishti (Babul Chishti), former MD of Farmers Bank AKM Shamim, First Vice President Swapan Kumar Roy, Vice President Md. Lutful Haque, former SEVP Gazi Salahuddin, Tangail. Shahjahan and Niranjan Chandra Saha of the same area.
Among the accused, Mahbubul Haque Chishti is in jail. The other six are on bail.
Besides, Surendra Kumar Sinha, Safiuddin Askari Ahmed, First Vice President of Farmers Bank, Ranjit Chandra Saha and his wife Santri Roy are absconding. They could not defend themselves as they were fugitives. 21 people have given witnesses in this case.
On July 10, 2019, the Anti-Corruption Commission (ACC) filed a case against 11 people, including SK Sinha. The case was filed at the ACC’s integrated district office, Dhaka-1. The plaintiff in the case is ACC director Syed Iqbal Hossain.
The accused were charged with loan fraud and embezzlement of Tk 4 crore.
Later, on December 10 of the same year, the ACC’s investigating officer Benazir Ahmed filed a chargesheet against 11 people, including SK Sinha. On August 13, 2020, Judge Sheikh Nazmul Alam of Dhaka Special Judge’s Court-4 framed charges against 11 people, including SK Sinha.
ACC sources said, the accused said. Shahjahan and Niranjan Chandra Saha opened two current accounts on November 8, 2016 at the Gulshan branch of Farmers Bank (now Padma Bank). On November 6, they applied for a loan of Tk 2 crore to Tk 4 crore. In the bank account opening and loan application form, both of them mentioned the address of house number 51, road number 12, sector 10, Uttara residential area. The house is the private property of former Chief Justice SK Sinha. In the loan application, 32 per cent land of Savri of Ranjit Chandra Saha’s wife Santri Roy Simi was shown as collateral. Both are former acquaintances of SK Sinha. The two loan applications have not been screened. The analysis of records and the rules and regulations of the bank were also not followed.
